The law that deals with criminal activities such as crimes against person, children, justice, involving property , financial, frauds, cyber, drug, sex, alcohol etc. This makes certain activity related to the above as illegal and punishable. This law defines the offenses and the procedure in which they shall be prosecuted and subsequently, if convicted, imprisoned and/ or fined. This is other than the standards of the conduct of the society, rules of the factory, offices, schools, colleges, etc.
Criminal procedure is the process through which these enacted laws are enforced. Once the crime has happened, the procedure through which the evidences are gathered and are presented to the court and are defended is the criminal procedure. At the end of the prosecution, depending upon the evidences produced and to the satisfaction of the judge(s), the quantum of sentence (punishment) is pronounced. The punishment also depends upon the crime committed and the reasons behind the same. However, if any of the party is not satisfied by the judgement, the same can be challenged in the higher court of law.
Since crimes are classified in different categories depending upon their nature and the intent, the punishment also varies. Some offenses related to the traffic and parking are considered to be minor and are dealt by the law enforcement agencies on their own. However, these are called as violations and not crime.
